Adventure Activity Participation Agreement

Effective upon Purchase

This Adventure Activity Participation Agreement ("Agreement") is entered into between AlMaknoon ("Company") and any individual or entity ("Participant") who purchases, registers for, or otherwise engages in any adventure activity offered by the Company, including via the Company’s online platform, electronic communication, or in-person transactions.

By purchasing or participating in any adventure activity, the Participant expressly acknowledges and agrees to all terms and conditions set forth herein, without the need for any further signature or action.

1. Activity Description

The Company organizes and facilitates various outdoor and adventure experiences, including but not limited to:

• Stand-Up Paddleboarding (SUP) Tours

• Sightseeing Tours

• Off-Road Adventures

• Camping Experiences

The specific services, locations, and experiences included in each activity are detailed in the respective product description at the time of purchase. The Company reserves the right to modify or adjust any advertised itinerary or service as necessary for safety, weather, logistical, or operational reasons.

2. Payment and Acceptance

Full payment is required at the time of booking. Accepted payment methods are displayed at checkout.

By submitting payment, the Participant confirms full acceptance of this Agreement and waives any right to claim non-acceptance based on lack of signature or separate documentation.

3. Assumption of Risk

The Participant fully understands and voluntarily accepts that all adventure activities inherently involve risks, including, but not limited to, personal injury, property damage, accidents, environmental hazards, unpredictable weather, and the actions of other participants.

The Participant voluntarily assumes all risks, whether known or unknown, and accepts full responsibility for any consequences arising from participation.

4. Waiver and Release of Liability

The Participant, on behalf of themselves, their heirs, personal representatives, and assigns, fully and forever waives, releases, discharges, and agrees to indemnify the Company, its owners, employees, contractors, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to participation in any Company activity, including claims arising from the negligence of the Company.

This release applies to all forms of liability, whether direct or indirect, foreseeable or unforeseeable.

5. Medical Fitness

By participating, the Participant certifies they are physically fit and sufficiently prepared to engage safely in the activities. The Participant acknowledges it is their sole responsibility to disclose any medical conditions that could affect participation.

The Company is not liable for any undisclosed medical conditions, injuries, or health complications that arise during or after participation.

6. Cancellation, Changes, and Refund Policy

• Participant-Initiated Cancellations:

  • Cancellations made at least 48 hours before the scheduled start time are eligible for a credit voucher redeemable for future Company activities, subject to availability. No cash refunds will be provided.

  • Cancellations made within 48 hours of the scheduled start time are non-refundable.

• Company-Initiated Changes or Cancellations:

  • The Company reserves the right to cancel, modify, or reschedule activities due to safety concerns, insufficient participant numbers, weather conditions, or other operational reasons.

  • In the event of a Company-initiated cancellation, the Participant will receive a credit voucher. Cash refunds are not guaranteed, unless required by Kuwaiti law.

• Early Departure:

  • If a Participant voluntarily withdraws from an activity after commencement, no refund, credit, or compensation will be provided.

• Force Majeure:

  • No refunds, credits, or liability will be provided for cancellations or disruptions caused by events outside the Company’s control, including but not limited to natural disasters, government actions, pandemics, travel restrictions, or acts of war.

7. Code of Conduct and Participant Responsibilities

Participants agree to:

• Follow all Company instructions, safety guidelines, and rules during the activity.

• Refrain from any illegal activities or disruptive behavior.

• Alcohol and hookah are strictly prohibited at all Company activities, regardless of local regulations.

• Respect the environment, local communities, fellow participants, and staff.

Violation of the Code of Conduct may result in immediate removal from the activity without refund or recourse.

The company reserves the right to stop providing its services to a participant at any time without providing an explanation and without a refund.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with:

• The laws of the State of Kuwait for activities conducted within Kuwait.

• International legal standards applicable to cross-border transactions and adventure activities.

Any dispute arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Kuwait City, State of Kuwait, unless otherwise required by applicable international laws.

9. Entire Agreement

This document constitutes the full and complete understanding between the Company and the Participant regarding participation in adventure activities. No oral representations, warranties, or promises shall alter or supplement this Agreement.

The Company may update these Terms and Conditions at any time without prior notice. The version in effect at the time of purchase governs the transaction.

By purchasing, booking, or participating in any Company activity, the Participant certifies that they have read, understood, and agreed to this Agreement in its entirety.
