Adventure Activity Participation Agreement

Terms & Conditions

Effective Upon Purchase

This Adventure Activity Participation Agreement (“Agreement”) is entered into between AlMaknoon (“Company”) and any individual or entity (“Participant”) who purchases, registers for, or participates in any adventure activity offered by the Company, whether through online platforms, electronic communication, or in-person transactions.

By completing a booking or participating in any activity, the Participant irrevocably acknowledges that they have read, understood, and agreed to all terms and conditions stated herein, without the need for any additional signature or confirmation.

1. Activity Description

The Company organizes and facilitates outdoor and adventure experiences, including but not limited to:

• Stand-Up Paddleboarding (SUP) Tours

• Sightseeing Tours

• Off-Road Adventures

• Camping and Multi-Day Experiences

The specific services, locations, schedules, and inclusions of each activity are described in the product listing at the time of purchase.

The Company reserves the right to modify, adjust, delay, shorten, or partially alter any itinerary, activity, or service when required for safety, weather conditions, environmental factors, logistical constraints, or operational reasons, without this constituting a breach of contract.

2. Payment and Acceptance

Full payment is required at the time of booking unless otherwise explicitly stated.

By submitting payment, the Participant confirms full and unconditional acceptance of this Agreement and waives any claim of non-acceptance due to lack of signature, physical documentation, or separate acknowledgment.

3. Mandatory Check-In Policy (Failaka & Multi-Point Trips)

Certain experiences, including but not limited to Failaka Island trips, involve multiple mandatory check-in points.

3.1 Mandatory Check-In Points

Participants must be present and checked-in at the following locations:

1. Boat departure point

2. Camp site arrival point

Failure to check-in at either of the above points shall result in:

• Immediate revocation of Company responsibility

• Automatic termination of participation

• Full forfeiture of the booking

• No refund, credit, or compensation under any circumstance

3.2 Activity Start Check-In

Check-in at the start of individual activities is optional.

All activities are optional by design, and non-attendance does not constitute a service failure or refund eligibility.

4. Boat Transportation Responsibility (Failaka Trips)

Booking, confirming, and attending boat transportation to and from Failaka Island is the sole responsibility of the Participant.

The Company:

• Does not book boat tickets on behalf of Participants

• Does not guarantee availability, schedules, or seat allocation

• Bears no liability for missed boats, delays, cancellations, incorrect bookings, or third-party operator issues

Failure to arrive on Failaka Island due to boat-related issues does not qualify for refunds, credits, rescheduling, or compensation.

5. Assumption of Risk

The Participant understands and acknowledges that adventure and outdoor activities inherently involve risks, including but not limited to:

• Personal injury

• Property damage

• Vehicle accidents

• Environmental hazards

• Wildlife encounters

• Unpredictable weather

• Actions or negligence of other participants

The Participant voluntarily assumes all risks, whether known or unknown, and accepts full responsibility for participation.

6. Waiver and Release of Liability

The Participant, on behalf of themselves, their heirs, assigns, and legal representatives, fully and irrevocably releases, waives, and discharges the Company, its owners, employees, guides, contractors, and affiliates from any and all claims, demands, damages, losses, or liabilities arising from participation, including claims arising from negligence.

This waiver applies to all forms of liability, whether direct, indirect, foreseeable, or unforeseeable.

7. Medical Fitness

By participating, the Participant confirms that they are medically, physically, and mentally fit to engage in the activities.

It is the Participant’s sole responsibility to disclose any medical conditions, injuries, allergies, or limitations prior to participation.

The Company bears no liability for injuries, complications, or health issues arising from undisclosed conditions.

8. Cancellation, Refund, and Attendance Policy

8.1 Participant-Initiated Cancellations

All Failaka Island trips and similar island or multi-point experiences are strictly non-refundable once booked.

No refunds, credits, transfers, rescheduling, or compensations will be issued under any circumstances, including but not limited to:

• Personal conflicts

• Failure to secure boat tickets

• Travel delays

• Medical reasons

• Weather discomfort

• Change of mind

By booking, the Participant expressly waives any right to request or claim a refund or alternative compensation.

8.2 No-Shows

Failure to be present at:

• The boat departure point, or

• The camp site check-in

shall be treated as a no-show, resulting in:

• Immediate termination of participation

• Full forfeiture of the booking

• No refund or compensation

8.3 Optional Activities

All activities within the experience are optional.

Failure to attend or participate in any activity does not qualify for refunds, credits, or compensation.

8.4 Early Departure

If a Participant voluntarily leaves the experience early for any reason:

• No refund, credit, or compensation shall be provided

• The Company bears no responsibility for alternative transport or arrangements

9. Conduct, Safety & Zero-Tolerance Policy

9.1 Prohibited Items

The following are strictly prohibited at all times:

• Alcohol

• Shisha

• Illegal drugs

• Recreational drugs

• Any intoxicating substances

9.2 Smoking Policy

Smoking is permitted only at designated areas far from:

• Camp sites

• Tents

• Bonfires

• Communal gathering areas

Smoking near fires or sleeping areas is strictly prohibited.

9.3 Accommodation & Tent Sharing

Tent sharing is strictly prohibited unless proof of immediate family relation or legal marriage is provided.

9.4 Inappropriate Behavior

Any inappropriate, aggressive, unsafe, disrespectful, or disruptive behavior may result in:

• Immediate termination of services

• Removal from the experience

• No refund or compensation

9.5 Camp Area Security & Movement Restrictions

Camping areas and tent placements are pre-designated by the Company to ensure maximum security, supervision, and emergency response capability.

Participants are strictly prohibited from:

• Moving tents away from the designated camp area

• Creating isolated or private camping zones

Any Participant who moves away from the designated camping area does so entirely at their own risk, and the Company immediately refrains from all security and safety responsibility for incidents occurring outside the designated area.

9.6 Independent Movement Outside Activity Scope

Participants who choose to:

• Drive independently to other locations

• Walk or explore outside designated activity areas

• Separate from the group convoy or guided routes

do so entirely at their own risk.

The Company bears no responsibility for accidents, injuries, getting lost, vehicle damage, being stuck, or emergencies arising from such independent movement.

9.7 Intoxication, Substance Influence & Authority Notification

Any indication, suspicion, or confirmation of intoxication will result in:

• Immediate removal from the experience

• Notification of relevant local authorities

• Possible detainment at authority discretion

• No refund or compensation

The Company bears no responsibility for legal consequences arising from such actions.

9.8 Identity Verification & Civil ID Requirement

For security and regulatory purposes, the Company reserves the right to request a copy of the Participant’s valid Civil ID or official government-issued identification at any time.

Failure or refusal to provide identification may result in immediate removal from the experience with no refund or compensation.

10. Accidents, Incidents & Legal Authority

In the event of vehicle accidents, altercations, theft, or major safety incidents, the matter shall be referred to the Failaka Police Station or relevant authorities. The Company will comply fully with official procedures.

11. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Kuwait.

Any dispute shall fall under the exclusive jurisdiction of the courts of Kuwait City.

12. Entire Agreement

This document constitutes the complete and final agreement between the Company and the Participant. No verbal statements or representations shall override this Agreement.

The Company reserves the right to amend these Terms & Conditions at any time. The version in effect at the time of purchase shall govern the transaction.
